10. These Terms of use are governed by the laws of England. If any provision of the foregoing is held to be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

11. Provident Financial Management Services Ltd may at any time revise these Terms of use without notice by posting changes on-line. You are responsible for reviewing all information posted on-line and the continued use of this website after changes are posted constitutes your acceptance of the modified Terms of use.

12. In the event that you purchase unsatisfactory goods or services using a voucher, you may have a right to sue either the retailer or ourselves as the supplier of the voucher or both. 

Hamper Terms and Conditions

 Please read these Conditions carefully. They set out important information about the terms upon which Provident sells hampers.

1. Parties: The Seller is Provident Personal Credit Limited (Company number 146091) whose registered office is at No. 1 Godwin Street, Bradford, West Yorkshire. BD1 2SU (“Provident”). The Customer (“You”) is anyone placing an order with Provident on these Conditions. The Supplier is Park Retail Limited (Company No. 402152) whose registered office is Valley Road, Birkenhead, Merseyside CH41 7ED (“Park”).

2. Prices: All prices shown in the Christmas hamper brochure (“the Brochure”) are inclusive of delivery costs and any applicable VAT. Should there be any changes in taxation which affect the price of the goods, Provident reserves the right to adjust such price accordingly.

3. Order Process: All orders are placed and accepted subject to these conditions. All Products shown in the Brochure are subject to availability. By placing an order with Provident You agree to making all required payments. Upon payment in full Provident will supply You with the Hamper(s) You have selected. Your hamper(s) will be supplied by Park Retail Limited acting on behalf of Provident.
IMPORTANT: On You placing an order, Provident will notify Park and place a conditional order with Park on Your behalf. At that point You are NOT committed to pay Provident the full price of the hamper(s) and may cancel and receive a refund of Your money less any cancellation charge to cover our administrative costs. At the point of Provident confirming the order, Provident will be committed to pay Park the price for the hamper(s). You will be notified prior to Provident confirming that order. If You do not cancel Your order by 3rd September 2012 You agree You will be liable for the full cost of the hamper(s) and Your right to a refund will be lost.

4. Payment: You will be required to make regular payments throughout the year and to have paid the price in full prior to despatch of the hamper(s) which will be in November or early December. An agent will call to Your home on a weekly basis to collect Your payments. Your payments will be recorded in a payment book which You will retain. It is Your responsibility to ensure Your agent signs the book against each payment made in order to maintain an accurate record of Your payments.
IMPORTANT: Your money will be paid into an account wholly controlled by Provident Financial plc (Company Number 668987) whose registered office is at No. 1 Godwin Street, Bradford, West Yorkshire BD1 2SU. This will be held separately from Provident and will not be used for any purpose of either business.

5. Our Right to Terminate: We reserve the right to terminate Your hamper order and refund any money You have paid in respect of the hampers ordered if, acting reasonably, we have reason to believe that You will be unable to meet Your obligation to make full payment for the hamper(s). You agree that we may rely upon Your payment history in relation to this agreement and that of any credit agreement(s) You have with us in assessing Your ability to meet Your obligations hereunder.

6. Refund and Cancellation Charge: You may cancel all or any part of Your order and receive a refund any time prior to Provident confirming Your order with Park. Provident reserve the right to charge a cancellation fee to cover administration costs. This charge will equal 5% or €20 (whichever is the lesser) of the total order value and will be deducted from the sum refunded.

7. Delivery: Items will be delivered in good time for Christmas provided Your account is paid in full. Delivery of Your hamper(s) will be detailed in the delivery advice letter You will receive from us or Park on our behalf during October. If You do not wish to take delivery of the hamper(s) on the date specified You must notify Park as soon as possible. Park will use its reasonable endeavours to deliver on a date You select. In the event of non-delivery due to incorrect information supplied by You, or if the intended recipient refuses to accept the delivery, Provident reserves the right to make a charge for re-directing/re-sending the consignment. All items should be received in a satisfactory condition. In the unlikely event that any item is not suitable for use or is damaged, please contact Park’s Careline Team. Every effort will be made to supply the exact item(s) ordered. However, if it is necessary to supply a substitute item because of availability, Provident reserve the right to supply an item of equal or greater value instead.

8. Alcoholic Products: Some of the products offered for sale include alcoholic drinks. In accepting these terms and conditions You are confirming that You are over the age of 18 and legally allowed to purchase alcoholic drinks and that they are not being purchased for anyone under the age of 18.

9. Limitation of Liability: Provident’s liability for misdelivery or defective products purchased from the Brochure shall, howsoever it arises including negligence, be limited to the value of Your order(s) save in relation to liability for death or personal injury which shall remain unlimited.

10. Use and disclosure of information: By signing this Contract You agree that Your information may be used for all purposes connected with the performance of the Contract including, if necessary, debt tracing and crime prevention and that We and others in the Provident Group may use information about You and Your account for the management of any of Your credit accounts including the following specific purposes; making credit decisions; tracing and debt collection; crime prevention and detection, market research, managing collections.

11. Marketing: Provident wants to tell You about products available from it and other group companies and other carefully chosen organisations. We will contact You with information about products and services for so long as You are a customer and for up to 12 months after You have paid up Your account. If You do not wish to receive such information or wish to opt out of receiving such at a later date You may do so by contacting Your Agent or by writing to Customer Relations, Provident Personal Credit Limited, No. 1 Godwin Street, Bradford, West Yorkshire. BD1 2SU or telephoning 1800 771 634.

12. Governing Law: This Contract shall be governed by and construed in accordance with the laws of the Republic of Ireland and be subject to the non-exclusive jurisdiction of the courts of Ireland
